By entering the Maltesers Gold Galentine’s Day competition (“Competition”), you agree to the following terms and conditions:

STANDARD TERMS

 

  1. Information on how to enter forms part of the terms of entry.

 

WHO CAN ENTER?

 

  1. Subject to clause 2, entry for the GA competition is open to residents of Australia aged 18 years and above who reside in Victoria, New South Wales, Queensland, Western Australia and South Australia. Entry for the VIP competition is open to residents of Australia aged 18 years and above who reside in Victoria, New South Wales and Queensland.

 

  1. Employees and their immediate family members of Mars Australia Pty Ltd (Operations) (“Promoter”), their associated agencies and companies and any prize suppliers are not eligible to enter. Reference to “Immediate Family Member” includes a spouse, de facto spouse, parent, natural or adopted child or sibling.

 

HOW TO ENTER

 

  1. The competition commences on 6th February at 06:00am (AEDT) and concludes on 7th February at 11:59pm (AEDT) (“the Competition Period”).

 

  1. In order to enter, consumers must:

 

  • Visit the promotion microsite and register their full name, address (including state and postcode), email address, on the Mars Competition page https://maltesers-gold-galentines-promotion.mailchimpsites.com/mars; and

 

  • Submit an answer to the Competition question, “In 25 words or less tell us why you and your bestie would like to join us for Galentine’s Day?”.

 

  1. Entries must be received by 7th February 11:59pm (AEDT). Entries will be deemed to be accepted at the time of receipt and not the time of transmission.

 

  1. Entries are limited to one entry per person. No repeat entries will be accepted.

 

  1. The entry must be:

           (a) the original independent creation of the entrant;

           (b) written in English; and

           (c) free from any claims, including but not restricted to copyright or trademark claims, by other parties.

 

  1. Entry details remain the property of the Promoter and will not be returned to the entrant. The prize winner agrees to grant the Promoter a perpetual and non-exclusive license to use their entries in all media worldwide and the prize winner will not be entitled to any fee for such use.

 

  1. Any entry that contains content that the Promoter, in its sole discretion, considers to be offensive or inappropriate in any way or that the Promoter considers, in its sole discretion, to infringe any intellectual property rights or other rights of any person, corporation or entity, will be considered ineligible. The decision to accept or reject an entry is at the Promoter’s sole discretion and no correspondence will be entered into.

 

  1. The Promoter is not responsible for any data or other information related to this Competition that may be lost, damaged as a result of any computer software or hardware malfunction. Any issues occurring as a result of computer / server/ software problems will be rectified as quickly as possible.

 

  1. Entrants must provide accurate and complete information when submitting entries, or the entry will be deemed invalid.

PRIZES

 

General admission (GA) tickets:

 

  1. There will be ninety-five (95) prize winners (“Winner”) of the Competition in the draw for general admission tickets. Each GA Winner will be awarded double passes (0) x tickets to Moonlight Cinema’s Galentine’s Day screening on 8 February 2023 in Melbourne, Sydney, Brisbane, Adelaide, and Perth.

 

  1. GA ticket winners will be provided an e-voucher sent via email. In order to guarantee their entry to their preferred film screening, winners must book their screening at their preferred venue at https://www.moonlight.com.au/ to gain entry to the film. If a winner does not book a screening they are not guaranteed entry to the film.

 

  1. If a General Admission Prize Winner (“Winner”) is unable to attend the Galentine’s Day screening on 8 February 2023 in the city they nearest reside (Brisbane, Sydney, Melbourne, Adelaide, Perth), they have the option of seeking to transfer their double pass ticket and rebook at another session in the Moonlight Cinema’s program.

 

  1. If a VIP double pass Winner is unable to attend the Galentine’s Day screening on 8 February 2023 in Melbourne, Sydney, or Brisbane, they have the option of seeking to transfer their double pass ticket and rebook GA seats at another session in the Moonlight Cinema’s program. VIP Winners cannot transfer their ticket to another VIP session.

 

  1. If adverse weather or other natural event means a film screening cannot go ahead, GA and VIP ticket holders can seek to reassign their ticket to another screening in accordance with relevant clauses outlined in these terms and conditions.

 

  1. The Winners’ companions can be under 18 years of age as long as they are accompanied by an adult and meet the recommended age and/or minimum age requirement for the film being shown at the session attended.

 

HOW TO WIN

 

  1. There will be eight hundred and seventy (870) general admission prize winners (“Winners”) and thirty-eight (38) VIP winners of the Competition.

 

  1. Each entrant who has entered the Competition over the Competition Period and registered all details in accordance with clause 3 (“Qualifying Entrant”) will be entered into the Competition.

 

  1. The Winner will be the best valid entry as judged by a panel of representatives appointed by the Promoter having regard to suitability, worthiness and creativity at Mars Australia Pty Ltd, Collins Square, Level 23, Tower 1, 727 Collins Street Docklands Melbourne 3008 by 8th February at 8:00am (AEDT). The Competition is a game of skill and chance plays no part in determining the Winner.

 

  1. The Winners will be contacted by email within three (3) business days of the selection. All necessary efforts will be taken to contact the Winner. If the Prize remains unclaimed or forfeited through ineligibility or otherwise, the Promoter will conduct a re-judging, as required, at the same time and place as the original judging, on 8th February 2023.

 

  1. The judges’ decision is final, and the Promoter will not enter into correspondence regarding the result.

 

  1. Incomprehensible and illegible entries will be deemed invalid.

 

  1. It is a condition of accepting the Prize that the Winner must comply with all the conditions of use of the Prize and Promoter’s requirements. Prizes are subject to Promoter’s and prize suppliers Terms and Conditions.

 

  1. It is a condition of accepting the Prize that the Winner may be required to sign a legal release in a form determined by the Promoter in their absolute discretion.

 

NO LIABILITY

 

  1. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, pandemic, COVID-19, epidemic, government restraint, or act of terrorism, the Promoter may in its absolute discretion cancel, modify or suspend the competition. If, due to circumstances beyond the Promoter’s control, the Promoter is unable to provide the stated prize, the Promoter reserves the right to award a substitute prize.

 

  1. Mars Australia Pty Ltd and their associated agencies and companies will not take any responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail, either physical or electronic.

 

  1. Promoter and prize suppliers are not responsible for any costs associated with Prize collection, including but not limited to travel expenses to and from the event.

 

  1. Mars Australia Pty Ltd and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss), expenses, damages or claim that may occur:

 

  • during the judging;

  • whilst undertaking any travel won on or connected with their entry into the Competition; or

  • in the participation in any prize;

  • as a consequence of late, lost or misdirected mail;

  • due to the broadcast of any program relating to the Competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;

  • in relation to failure of an entry to be received by the Promoter on account of technical problems or traffic congestion; and

  • arising from or related to any problem or technical malfunction of any computer equipment, software, internet connection, any injury or damage to entrant’s or any other person’s computer software related to or resulting from participation in this promotion.

 

  1. If for any reason the Competition is not capable of running as planned, due to causes including but not limited to computer virus, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to state government legislation.

The Promoter reserves the right to reasonably amend or vary these terms and conditions at its sole discretion, orally or in writing.

 

  1. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

 

  1. Mars Australia Pty Ltd and its Prize Suppliers assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, and reserves the right to take any action that may be available.

 

  1. By entering the Competition, and by collecting the Prize, the Winner acknowledges and accepts that driving, travel and any other activities comprising the Prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. Neither the Promoter or prize supplier are responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst a Winner is travelling. It is the responsibility of the Winner to enquire about local issues and conditions at destinations prior to travel.

  2. In the event Moonlight Cinema cancels an event due to adverse weather, the promoter Daily Telegraph will not be liable to refund the ticket. Please refer to Moonlight Cinemas Terms of Sales Policy for definition of adverse weather and policy https://www.moonlight.com.au/terms-of-sale/

     

  3. In the event Moonlight Cinema cancels the screening on the 8th February 2023, GA Ticket holders will be able to reschedule the screening using their e-voucher before 18th February for Adelaide and Brisbane and before the 26th March 2023 for Melbourne, Sydney and Perth residents. In order to guarantee their entry to their preferred film screening, GA Winners must book their screening at their preferred venue at https://www.moonlight.com.au/ to gain entry to the film. If a GA Winner does not book a screening they are not guaranteed entry to the film.

  4. If the screening of Magic Mike on the 8th February is cancelled, there is no guarantee they will be able to reschedule to another Magic Mike screening. The screening is subject to the Moonlight cinema pre-confirmed schedule.

 

PROMOTER’S DETAILS

 

  1. The Promoter is Mars Australia Pty Ltd t/as Mars Wrigley Confectionery (ABN 48 008 454 313) of Tower 2, Collins Square, 727 Collins Street Docklands, Melbourne VIC 3008, telephone +61 2 9847 9111.

  2. With your express consent to do so, by opting in via the competition entry form, the Promoter will handle entrant’s personal information (e.g., first name, last name, address, suburb, state, postcode, phone number, email address, date of birth) for the purposes of conducting the Competition in accordance with their privacy policy, which can be accessed at https://www.mars.com/privacy, and may disclose the entrants’ personal information to third parties including its contractors and agents, prize suppliers and service providers to assist in conducting this Competition and to the State and Territory lottery departments as required under the relevant lottery legislation. The Promoter’s Privacy Policy may be updated from time to time, and it will be the entrant’s responsibility to keep up to date with any changes to the Privacy Policy. If you opt in to receive future marketing materials the Promoter will use this information for future marketing purposes regarding its products, including contacting the entrant electronically. The entrant may at any time, opt out of receiving marketing communications or further contact from the Promoter by e-mailing contact@auc.mars.com.

  3. Entry details remain the property of the Promoter. Mars Australia Pty Ltd (ABN 48 008 454 313) and its related entities collect your personal information for the purpose of conducting and promoting this Competition, including for the purpose of identifying and notifying the Winner, prize fulfilment and understanding our audiences.
